蘋果攪局 三星新平板無緣登澳 【10:30】
〔中央社〕澳洲聯邦法院法官班奈特（Annabelle Bennett）今天同意蘋果 (Apple US-AAPL)的要求，對三星電子 (Samsung Electronics KR-005930)銀河平板電腦（Galaxy Tab 10.1）下達了在澳洲暫停銷售的禁令。
據彭博報導，澳洲法官裁定，三星與蘋果之間的專利訴訟解決前，暫時禁止銀河平板在澳洲銷售。這項裁決意味著三星銀河平板恐永遠無法進軍澳洲市場。
三星代表律師Neil Young 4日在雪梨向班奈特法官表示，三星曾透露，法院若同意蘋果下達禁售令要求，三星或將放棄在澳洲銷售銀河平板電腦，因錯過了聖誕採購旺季，這款新平板的命運相當於「死亡」。
蘋果聲稱三星平板至少侵犯三項專利，蘋果向三星提告迫使銀河平板延後逾2個月登澳。
蘋果與三星這兩大科技巨擘在全球大舉興訟，雙方的官司纏訟已延燒四大洲。三星與蘋果的專利大戰始於4月，當時蘋果率先發難，在美國提告，指控三星銀河系列手機與平板電腦侵犯蘋果iPhone與iPad。
德國法院8月下令暫停禁售三星銀河平板，三星已提請上訴。三星與蘋果之間的侵權官司也打到南韓、日本與荷蘭。
三星代表律師Young本月稍早透露，科技產品日新月異，就算銀河平板僅延後一個月上市，也將危及這項產品的銷售前景。
Young指出，蘋果如果同意取消申請銀河平板禁售令，三星建議快速審理本案。他表示，蘋果拒絕了這項提議。
三星表示，由於必需蒐證，重新開庭將等到明年了。

Samsung Electronics scored its first legal victory in a global patent war with Apple on Wednesday when an Australian appeals court overturned a sales ban for the Galaxy Tab 10.1 tablet PC.
Apple says it will appeal to the Australian High Court in Canberra and applied for another injunction against Samsung products in a German court. (德國戰場參閱這裡)
An Australian district court on Oct. 13 banned sale or marketing of the Galaxy Tab 10.1 by agreeing that Samsung violated Apple's patent for the "multi-touch" sensing technology.
But all three appeals court justices agreed with Samsung that it would suffer a huge loss if the sale of the Galaxy Tab is banned regardless whether the patent was infringed. (問題先推回專利侵權之確認)
Justice Lindsay Foster said Samsung would take a severe blow if the sale of a tablet PC, whose product lifecycle is only about a year, is banned before the High Court reaches its decision, while Apple failed to prove that it would suffer serious damage if the sales ban was lifted.
The decision comes into force at 4 p.m. on Friday, allowing Samsung to put out the product for the crucial Christmas season.
The ruling is a boost for Samsung, which has also applied for an injunction against Apple's iPhone and iPad2 in Australia.
Apple has lost several patent suits this month against NT-K, a small Spanish tablet PC maker, and Motorola. (青蘋果喔)
